Please read these Terms of Service ("Terms") carefully before using the EverHome Caregivers website and services (the "Service") operated by EverHome Caregivers ("us", "we", or "our").

1. Non-Medical, In-Home Care Services

EverHome Caregivers provides non-medical, in-home care services designed to assist clients with activities of daily living, companionship, light housekeeping, and general supervision. Our services are strictly non-medical in nature.

Our caregivers are not medical professionals, nurses, or physicians. We do not provide medical advice, diagnosis, treatment, medication administration, or any form of clinical medical care. If a client is experiencing a medical emergency, you must immediately call 911 or contact a qualified healthcare provider.

2. No Liability for Medical Care

By using our services, you acknowledge and agree that EverHome Caregivers, its officers, directors, employees, and agents shall not be held liable for any medical outcomes, injuries, health complications, or damages resulting from underlying medical conditions or the need for medical care. You remain solely responsible for the medical decisions and healthcare management of the client receiving our non-medical services.

3. Jurisdiction and Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Services provided shall be instituted exclusively in the federal or state courts located in Arizona, and you irrevocably consent to the jurisdiction of such courts.

4. Limitation of Liability

In no event shall EverHome Caregivers, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; and (iii) unauthorized access, use, or alteration of your transmissions or content.

5. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
